FDA Warning Disclaimer for CBD Products
For compliance with FDA regulations, CBD products must include clear disclaimers on labeling and marketing materials to avoid implying unapproved medical claims. The standard FDA-required disclaimer, as emphasized in FDA guidance and commonly used by compliant companies, is:
“These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.” 5 10 12 14
Additionally, many states and sellers incorporate age restrictions and safety warnings, such as: “This product is not for use by or sale to persons under the age of 18 (or 21 in some jurisdictions). Consult with a physician before use if you have a serious medical condition or use prescription medications.” 6 7 11 The FDA has issued warning letters to companies making unsubstantiated health claims about CBD, reinforcing that CBD is not approved as a dietary supplement for therapeutic purposes and cannot be marketed as such without pre-approval. 5 8 9 13 Always consult official FDA resources for the latest updates, as regulations may evolve.
Legal Definition of Hemp
Under the U.S. Agricultural Improvement Act of 2018 (commonly known as the 2018 Farm Bill), hemp is legally defined as: the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol (THC) concentration of not more than 0.3 percent on a dry weight basis. 15 16 17 18 19 This definition distinguishes hemp from marijuana (which exceeds 0.3% delta-9 THC) and legalizes its cultivation, production, and sale at the federal level, provided it meets the THC threshold and complies with state and federal regulations. Hemp-derived products, including CBD, must adhere to this standard to be considered legal nationwide. For your legal page, consult the full text of the 2018 Farm Bill or USDA guidelines for any state-specific variations.
